Terms and Conditions

Sleep to Flourish

1. DEFINITIONS

Sleep to Flourish means Sleep to Flourish, operated by Adria Stea.

Services means consultations, sleep support packages, discovery calls, follow-up support, sleep plans, educational resources, and any other professional services provided by Sleep to Flourish.

 

Products means digital products, downloadable guides, e-books, templates, routines, sleep resources, and other educational materials supplied by Sleep to Flourish.

Client means any individual purchasing Products or Services from Sleep to Flourish.

Website means www.sleeptoflourish.com and associated pages.

 

2. ACCEPTANCE OF TERMS 

By purchasing a Product, booking a Service, completing an intake form, downloading resources, or using our Website, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you must not purchase or use our Products or Services.

 

3. SERVICES AND PRODUCTS 

Sleep to Flourish provides evidence-based infant and child sleep education, guidance, and support.

Upon booking a Service, Clients may be required to complete an intake questionnaire. It is the Client's responsibility to ensure all information provided is accurate, complete, and up to date.

Any personalised sleep plans or recommendations provided are tailored specifically to your child and family circumstances and must not be relied upon by others.

Digital Products will be delivered electronically following successful payment.

4. PRICING AND PAYMENT 

All prices are listed in Australian Dollars (AUD).

Full payment is required prior to the delivery of any Service or Product unless otherwise agreed in writing.

Payments may be processed through approved third-party payment providers, including Stripe, PayPal, Afterpay, or credit/debit card facilities.

 

Sleep to Flourish reserves the right to modify pricing at any time without notice.

5. DISCOVERY CALLS 

Complimentary discovery calls are intended to help determine whether Sleep to Flourish services are suitable for your family's needs.

Discovery calls do not constitute professional sleep advice, diagnosis, or the commencement of a consulting relationship.

Sleep to Flourish reserves the right to decline services where appropriate.

6. SAFE SLEEP AWARENESS 

The Client agrees to follow current safe sleep recommendations at all times.

This includes, but is not limited to:

  • Placing babies on their back to sleep.

  • Maintaining a safe sleep environment.

  • Avoiding loose bedding, toys, pillows, and comforters in sleep spaces.

  • Following age-appropriate safe sleep recommendations.

  • Adhering to current Red Nose Australia Safe Sleep Guidelines.

7. MEDICAL DISCLAIMER 

Sleep to Flourish provides educational and behavioural sleep support only.

The information, recommendations, Products, and Services provided do not constitute medical advice, diagnosis, treatment, or healthcare services.

Clients must seek advice from their child's GP, paediatrician, maternal and child health nurse, lactation consultant, or other qualified healthcare provider regarding any medical concerns.

Where recommendations from a medical professional differ from advice provided by Sleep to Flourish, medical advice must take precedence.

Sleep to Flourish may request written medical clearance before commencing support where medical concerns are present.

8. CLIENT RESPONSIBILITIES 

The Client agrees to:

  • Provide accurate and complete information.

  • Disclose any medical conditions, developmental concerns, medications, diagnoses, or health issues that may affect sleep.

  • Follow all advice provided by their healthcare professionals.

  • Communicate openly throughout the support process.

  • Notify Sleep to Flourish of any significant illness, hospitalisation, or health changes affecting the child.

 

The effectiveness of any sleep plan relies on the Client's implementation and consistency.

 

 

9. RESULTS DISCLAIMER 

Every child and family is unique.

 

Sleep to Flourish provides evidence-based education, guidance, and support; however, specific sleep outcomes cannot be guaranteed.

 

Results vary depending on numerous factors, including but not limited to:

  • Child temperament

  • Developmental stage

  • Medical conditions

  • Family circumstances

  • Consistency of implementation

 

The Client acknowledges that success depends on many factors beyond the control of Sleep to Flourish, and therefore no guarantees are made regarding specific sleep outcomes.

 

10. SUPPORT PERIODS 

Support packages must be commenced within seven (7) days of the initial consultation unless otherwise agreed.

 

If a child becomes unwell during the support period, Sleep to Flourish may pause support for up to forty-five (45) days at its discretion.

If Sleep to Flourish attempts to contact the Client on three (3) occasions during the support period and receives no response, Sleep to Flourish reserves the right to consider the support period complete and the Services fulfilled.

If the Client fails to attend a scheduled consultation without prior notice, a 20-minute grace period will apply. If no contact is received during this time, the consultation will be deemed completed and no refund or replacement consultation will be provided.

11. REFUND POLICY 

 

Digital Products

Due to the immediate nature of digital downloads, all purchases of digital products, guides, templates, and downloadable resources are final and non-refundable, except where required under Australian Consumer Law.

 

Consultations and Support Packages

All consultations, sleep support packages, and personalised sleep plans are non-refundable except where required under Australian Consumer Law.

If you wish to cancel or reschedule an appointment, at least seven (7) days' notice must be provided. Requests made within seven (7) days of a scheduled consultation may not be eligible for rescheduling or refund, as preparation and planning for your family's support may have already commenced.

Once a consultation has occurred, a personalised sleep plan has been created, recommendations have been provided, or a support period has commenced, no refunds will be available.

No refund will be provided if:

  • You choose not to proceed after receiving your sleep plan or recommendations.

  • You choose not to utilise part or all of your support period.

  • You decide the service is no longer suitable for your family after support has commenced.

While Sleep to Flourish provides evidence-based guidance and personalised support, sleep outcomes cannot be guaranteed as results depend on many factors, including your child's temperament, development, health, and the consistency with which recommendations are implemented.

Nothing in this policy excludes, restricts, or modifies any rights you may have under Australian Consumer Law.

 

 

12. TERMINATION OF SERVICES

Sleep to Flourish reserves the right to terminate services immediately where:

  • False or misleading information has been provided.

  • The Client breaches these Terms.

  • Abusive, threatening, disrespectful, or inappropriate behaviour occurs.

  • The consulting relationship is no longer considered appropriate.

No refund will be payable in these circumstances.

13. INTELLECTUAL PROPERTY 

All materials supplied by Sleep to Flourish, including but not limited to:

  • Sleep plans

  • Guides

  • Templates

  • Educational resources

  • Emails

  • Website content

  • The Flourishing Sleep Framework™

  • F.L.O.U.R.I.S.H.™ resources

  • Blog content

remain the intellectual property of Sleep to Flourish.

Clients are granted a personal, non-transferable licence to use materials for their own family only.

Materials must not be copied, reproduced, distributed, shared, sold, published, modified, or used for commercial purposes without written permission.

 

14. CONFIDENTIALITY 

Personal information shared by Clients will be treated confidentially and handled in accordance with applicable Australian privacy laws.

Personalised sleep plans are prepared specifically for the Client's child and family circumstances and must not be shared, distributed, reproduced, or provided to any third party without written consent from Sleep to Flourish.

15. LIMITATION OF LIABILITY 

To the fullest extent permitted by law, Sleep to Flourish shall not be liable for any direct, indirect, incidental, consequential, or special loss, injury, damage, or expense arising from the use of Products or Services.

Clients use all information and recommendations at their own discretion and risk.

16. DISPUTE RESOLUTION 

If a dispute arises, both parties agree to first attempt to resolve the matter in good faith through discussion.

If unresolved, the parties agree to participate in mediation before commencing legal proceedings.

17. GOVERNING LAW 

These Terms and Conditions are governed by the laws of Victoria, Australia.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

19. SEVERABILITY 

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
